MIGRATION PLANNING · AFTER 45

Your experience still deserves a careful assessment

Turning 45 can change a migration plan. Before choosing a regional move or relying on a sponsorship promise, understand what a DAMA can—and cannot—change.

Can you obtain an Australian visa after 45?

Age 45 is not a universal cut-off for every Australian visa. Different visas and streams have different rules. A temporary sponsorship option and a permanent residence pathway also need to be considered separately.

For people searching for a “DAMA visa over 45”, the useful starting point is whether a particular agreement permits the required age concession for their occupation and intended visa stage. A DAMA is not a separate visa and cannot be applied for independently by a worker.

The NT Government concessions page gives one concrete example: its DAMA publishes age limits of under 55 for skill level 1–4 occupations and under 50 for skill level 5 occupations. These limits are specific to those NT arrangements. Other agreements need their own review.

The question to ask is: “Which agreement, employer, role and visa stage fit my circumstances?” That produces a more useful assessment than asking whether Australia has an over-45 visa.

Why DAMA changes the questions you should ask

Under the Home Affairs framework, regional head agreements establish occupation coverage and agreed flexibility, while endorsed employers seek individual labour agreements. Sponsorship can use relevant 482, 494 or 186 visa programs, depending on the arrangement.

This creates a chain of checks: the location must fit, the job must fit, the employer’s approval must fit and the worker must meet the relevant criteria. An age concession cannot repair an unrelated gap in the role or employer requirements.

That is why a screenshot of an occupation list rarely answers the whole question. Keep the source link and publication date, then check the exact occupation conditions and proposed visa stage.

Five checks before you rely on a DAMA pathway

  1. Confirm the real occupation. Compare your daily duties with the nominated occupation. A similar title does not necessarily mean the same migration classification. Prepare a short duty summary supported by employment records.
  2. Confirm the worksite. Use the employer’s actual location, not the nearest major city or a general “regional Australia” label. The relevant agreement defines its coverage.
  3. Confirm the employer’s position. Ask whether the business is exploring sponsorship, has regional endorsement, holds an approved labour agreement, or is ready to nominate. These are different stages.
  4. Read the concession for the intended visa. Check the age boundary and when it must be met. Also examine English, skills assessment, experience and any other conditions that remain relevant.
  5. Test the future plan. Work backwards from a proposed permanent stage. Consider your expected age, required employment period, employer support and the evidence you would need then.

These checks are useful preparation for professional advice. They are not a substitute for examining the applicable agreement and current visa rules.

Temporary sponsorship and permanent residence are separate decisions

Planning questionWhat to establish
Can I be sponsored now?The relevant visa stream, eligible role, employer approvals and your present circumstances.
Can I qualify for a later permanent stage? The pathway’s own age, employment, occupation and other requirements at the relevant time.
What if my role or employer changes? How the change affects visa conditions, sponsorship and the proposed future pathway before acting.
What should I budget for?The separate application stages, evidence costs, professional assistance and family relocation needs.

The NT permanent residence pathway guidance describes distinct 186 and 494-to-191 pathways with their own criteria. It is a useful reminder that holding a temporary visa does not by itself establish eligibility for permanent residence.

An example: the missing step in a promising plan

Illustrative scenario, not a client case. A 49-year-old worker finds their occupation on a regional agreement list and assumes a move will lead to permanent residence. A prospective employer says sponsorship may be possible.

The next step is to establish the employer’s approvals, the actual duties, the relevant age concession and the proposed permanent stage. If a period of qualifying work is involved, the worker should examine their age at that later stage. A broad age concession headline is not enough to resolve the timeline.

Write the plan down as separate milestones: employer preparation, temporary application if applicable, qualifying employment and permanent application if available. Mark the assumptions beside each milestone. An adviser can then explain which assumptions have evidence and which still need verification.

Does living in Geelong give you access to a Victorian DAMA?

No automatic connection should be assumed. The Great South Coast DAMA’s published coverage includes six named local government areas in south-west Victoria; Greater Geelong is not one of them. Regional status under a different visa program does not establish coverage under that agreement.

For a worker based in Geelong, Wyndham Vale or Manor Lakes, start with the proposed employer’s worksite. Your current home address, an agent’s office and the job location are different facts.

There is also an industry check. The Great South Coast’s March 2026 update says an occupation available under an Industry Labour Agreement can only be endorsed through DAMA where the worker’s industry differs from the industry covered by that agreement. Aged care and other industry-based arrangements should therefore be assessed on their own terms.

Three assumptions that can derail the research

01

“My occupation is listed, so I qualify.”

A list is one part of the assessment. Duties, qualifications, experience, employer arrangements and the intended visa stage still need checking.

02

“The employer appears on an official list, so it is hiring.”

An agreement listing does not establish a current vacancy or a willingness to sponsor you. Seek a genuine employment discussion; do not treat a list as a recruitment guarantee.

03

“The same concession applies everywhere.”

Read the agreement for the actual region and occupation. A social post about one DAMA should not be reused as the rule for another.

A practical preparation checklist

Bring a one-page profile to your consultation. Include your date of birth, occupation and main duties, relevant qualifications, employment dates, English results and skills assessment history. If you are in Australia, add your visa type, expiry date and relevant conditions.

For the employer side, note the business name, industry, worksite postcode, proposed role and what the employer has actually agreed to discuss. Separate confirmed facts from possibilities. If there is no employer yet, say so; it changes what can usefully be assessed now.

Also record your family’s practical priorities: location, schools, partner employment, housing and the cost of moving. A technically possible pathway should be considered alongside a realistic life plan.

Use the initial enquiry form for a brief summary. Send passports, financial records and other sensitive documents only when requested through an appropriate channel.

Questions about DAMA after 45

Is 55 the maximum age for every DAMA?

No. Age concessions vary. The NT example discussed here distinguishes under-55 and under-50 limits by occupation skill level. Check your actual agreement, occupation and visa stage; do not treat “up to 55” as a national rule.

Can I apply without an employer?

No independent worker application is available under DAMA. Home Affairs requires an employer in the designated region and an occupation specified in the agreement.

Should I move to a region before obtaining advice?

Check the employer, agreement and individual visa position before making commitments. Relocation alone does not create sponsorship or establish visa eligibility.

What if DAMA does not fit my situation?

A consultation can compare other pathways relevant to your circumstances, including any applicable exemptions or different visa categories. The purpose is to identify a supportable plan, rather than force your circumstances into one program.
