Types of Partner Visas

Partner (Provisional and Migrant) Visa – Subclass 309/100

These offshore visas allow the partner of an Australian citizen or permanent resident to join them in Australia. The Subclass 309 is temporary and leads to the permanent Subclass 100 after two years if the relationship is ongoing. Applicants must apply from outside Australia and provide relationship evidence, health and character documents.

Partner (Temporary and Permanent) Visa – Subclass 820/801

These visas apply to onshore applicants already in Australia. Subclass 820 is the first stage and leads to Subclass 801 after two years, offering permanent residency. Applicants must prove their relationship is genuine and continuing, with shared financial, social, and household commitments. 

Prospective Marriage Visa – Subclass 300

This offshore visa is for fiancés of Australian citizens or permanent residents who plan to marry in Australia. It allows entry and stay for up to nine months. After marriage, applicants can apply for the Partner visa (Subclass 820/801). Requirements include intention to marry, evidence of a genuine relationship, and meeting health and character checks.
